Bill Cosby is demanding he be released on bail while he appeals his conviction for aggravated indecent assault.
His lawyers filed a motion on Wednesday with the Pennsylvania Superior Court claiming that the judge “trampled” on his rights.
Former TV veteran Cosby is serving three to 10 years in a state prison for drugging and sexually assaulting Andrea Constand at his home 15 years ago.
He Maintains His Innocence
The 81-year-old actor/comedian was sentenced in September 2018.
The man once known as “America’s Dad” has always maintained his innocence in all allegations of sexual assault.
“Mr. Cosby’s right to have his appeal heard in a timely manner by this court is being trampled by the lower court’s inordinate delay in issuing his … opinion,” the motion read, according to CNN.
The motion went on to state that “bail is justified given his advanced age and the strong likelihood that his conviction will not stand on appeal.”
“A Racist And Sexist Trial”
Cosby has also attacked his trial judge Steven O’ Neil.
Through his legal team the Cosby show star accused O’Neill of displaying “disgust and prejudice” against him. Last year, Cosby’s spokesman called the prosecution “the most racist and sexist trial in the history of the United States.”
Cosby’s attorneys asked that the “scandalous judge be removed immediately, and Mr. Cosby be granted bail throughout the appeals process, because the judge’s racial hatred towards Mr. Cosby clouds his better judgment to be a good steward of the bench.”
He Claims O’Neill Is Corrupt
Cosby also was quoted in the statement, as calling his trial judge “complicit in the corruption against me.”
He also called O’Neil “an accessory to the incestuous behavior that resides in Montgomery County.”
“I’m just so happy, because this guy is proving my innocence,” Cosby said. “And guess what else. America is finally getting to witness the truth.”
Cosby is imprisoned at SCI Phoenix, a maximum security prison outside Philadelphia. He was recently moved to the prison’s general population.
