Jussie Smollett may actually have his day in court.

If a Chicago attorney gets his way, he could be re-charged with allegedly staging a “race hate attack” on himself.

Saani Mohammed has called for a special prosecutor to investigate the Smollett case. Mohammed filed a petition asking for the investigation into Cook County State’s Attorney Kimberly Foxx’s decision to drop the 16 felony charges against the Empire star.

Foxx Received A No Confidence Vote

Up until recently, attorney Saani Mohammed worked side by side with Cook County State’s Attorney, Kimberly Foxx.

But according to documents obtained by the Chicago Tribune, Mohammed has accused Foxx of of “improperly using her position to intervene in the investigation” after meeting with one of Smollett’s relatives.

Chicago police union chiefs have also demanded the resignation of Foxx over her office’s handling of the case.  Police chiefs associations announced they passed a “no confidence” vote against Foxx during a joint news conference yesterday afternoon.

Kevin Graham, president of the Fraternal Order of Police, said the vote was about more than just the Smollett case, NBC News reports.

Chicago Will Sue Smollett

The announcement came as the city of Chicago confirmed they will sue Smollett for the costs of police overtime spent investigating his claims.

Prosectors believe Smolett lied that he was the victim of a racist and homophobic attack.

The lawsuit came after the 36-year-old actor/singer refused to pay for the cost of the investigation which is said to be $130,000.
