Apparently, R. Kelly’s loss in the sex abuse case could have been avoided, because Heather claims she tried to settle outta court. However, when his team didn’t respond, she served papers to R. Kelly when he was locked up in a Cook County, IL jail for outstanding child support payments to his ex-wife, Andrea “Drea” Kelly.
That’s where Atty. Brian Nix says his client, R. Kelly’s, confusion and overwhelming emotions about Heather’s sex abuse case was sparked…
Following the default judgement, Nix spoke on behalf of R. Kelly to TMZ:
“R. Kelly was served while incarcerated on the child support case and he was overwhelmed by the experience of being in jail.” …
[Attorney Brian] Nix says, “[Being overwhelmed] coupled with Mr. Kelly not being cognizant of what the motion fully meant led to him missing the hearing. I had no idea he had been served.”
R. Kelly and Heather will face off in court in May 2019, to find out the amount he must pay her in damages.
Meanwhile, Attorney Nix is trying his hardest to get the default judgement tossed out and instead get a new court date to hash things out in court solely based on the details of the case.
Only time will tell which option the court decides…we’ll keep y’all posted.
